These Terms & Conditions apply to your use of the Avondale Foods online store at www.shop.avondalefoods.com.au (“Online Store”) and to purchases made through the Online Store.
The Online Store is operated by Avondale Foods Pty Ltd (“Avondale Foods”, “we”, “us” or “our”).
By using our Online Store or placing an order, you agree to these Terms & Conditions.
1. About Our Online Store
Our Online Store provides fruit ingredients and related products for purchase by customers in Australia.
Our products are intended for food manufacturing, baking, food service and other commercial or business applications, unless otherwise stated.
2. Product Information
We make reasonable efforts to ensure that product descriptions, images, specifications and other information displayed on our Online Store are accurate and current.
However, product images are for illustrative purposes and may vary slightly from the actual product or packaging.
Product availability may change without notice.
3. Pricing
All prices are displayed in Australian dollars (AUD).
Prices shown on the Online Store include GST where applicable.
We reserve the right to change prices at any time. Any price change will not affect an order that we have already accepted and confirmed, except where permitted by law.
Shipping charges, where applicable, will be displayed during checkout.
4. Orders
When you place an order, you are making an offer to purchase the products selected at the price displayed at checkout.
Your order is not accepted until we have confirmed the order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product information error;
- we are unable to verify payment;
- delivery cannot reasonably be completed; or
- we reasonably suspect fraudulent or unauthorised activity.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
5. Payment
Payment is processed through the payment methods available at checkout, which may include Shopify Payments and PayPal.
By submitting payment, you confirm that you are authorised to use the payment method provided.
6. Delivery
We currently deliver within Australia only.
Orders are generally dispatched within 1–2 business days after payment has been successfully processed, subject to product availability and operational circumstances.
Delivery is arranged using our nominated shipping and logistics providers, including TNT/FedEx and Shippit.
Delivery timeframes provided at checkout or elsewhere on the Online Store are estimates only and may be affected by circumstances outside our reasonable control.

7. Product Storage and Use
Our products are shelf-stable and intended to be stored under ambient conditions unless otherwise stated on the product packaging.
Customers are responsible for following all storage, handling and use instructions provided with the product.
Once a product has been delivered, customers are responsible for storing the product appropriately and maintaining the product in accordance with any applicable instructions.
8. Food Products
Due to the nature of food ingredients, we cannot accept returns simply because a customer has changed their mind.
This does not affect your rights under the Australian Consumer Law.
If you believe a product is faulty, damaged, incorrect or does not meet a consumer guarantee, please contact us as soon as possible so we can assess the issue and provide an appropriate remedy.
9. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or other applicable legislation.
Where a product does not meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
10. Limitation of Liability
To the extent permitted by law, Avondale Foods will not be liable for loss or damage arising from circumstances beyond our reasonable control, including delays caused by shipping providers, natural disasters, severe weather, industrial action, government restrictions, supply interruptions or other events outside our reasonable control.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under Australian law.
11. Website Use
You must not use our Online Store for unlawful purposes or in a way that could damage, disable, overburden or impair the website.
You must not attempt to gain unauthorised access to our website, systems or customer information.
12. Intellectual Property
All content on the Online Store, including text, photographs, graphics, logos, product information and other materials, is owned by or licensed to Avondale Foods and is protected by applicable intellectual property laws.
You must not reproduce, modify, distribute or commercially use our content without our prior written permission.
13. Privacy
Personal information collected through the Online Store is handled in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms & Conditions from time to time.
The latest version will be published on the Online Store and will apply from the date of publication.
15. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
